These terms and conditions (PDF Version) apply to the use of this Website and Registration for the Service and by accessing this Website and/or registering for the Service you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions you may not use or access this Website.

"Terms" means these terms and conditions; "Website" means the website located at www.pmc-uk.net; "Registration" means the registration process for the Service; "Service" means the PMC student service; "Contact Forms" means the Expression of Interest or Contact PMC forms used by this Website; "Personal Information" means the details provided by you on Registration; “Cookies” means small text files which this Website places on your computer’s hard drive to store information about your session and to identify your computer; "PMC" means Phil Moss Consulting.

You are provided with access to this Website in accordance with these Terms and any activity to which you enter into on this Website is strictly in accordance with these Terms.

Every attempt is made to ensure that the information on this Website is correct and up-to-date, but no warranty is given as to its accuracy or reliability. PMC accepts no liability for any inaccuracies or any loss incurred as a result of any inaccuracies. You accept that PMC shall not be liable in any event for any direct, indirect or consequential loss or damages arising from the use of the Website.

Intellectual Property and Right to Use

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Website shall remain vested in PMC. You are permitted to use this material only as expressly authorised by PMC.

You acknowledge and agree that the material and content contained within the Website is made available for your personal non-commercial use only and that you may download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content of the Website is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

Members Area

When you register you will select a username and password. You are responsible for all sessions and activity which take place under these details. You should keep your username and password safe and must not disclose them to any other person/s. PMC reserves the right to prevent login access to the Members Area if these Terms are breached.

Third Party Websites

The Website provides links to third-party websites for your convenience and information. If you access these links, the page will open in a new browser window or tab. PMC does not control these sites, their content, terms or privacy practices.

Indemnity

You agree fully to indemnify, defend and hold PMC harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Terms by you or any other liabilities arising out of your use of this Website, or the use by any other person accessing the Website using your username and password and/or your Personal Information.

Service

Registration

On Registration for the Service, you warrant that:

The Personal Information which you are required to provide when you register is true, accurate, current and complete in all respects.
You will notify PMC immediately of any changes to your Personal Information.
You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.
You agree to be bound by these Terms.

Contract

A legally binding contract between you and PMC will be formed when you receive an email from PMC confirming Registration has been successfully completed and payment of the fee has been received.

The contract entitles you to receive the following elements of the Service: Individual Report; Counselling Session; Application Preparation; On-Going Support; Online Services, located in the Members Area of the Website. These elements are described on the Website.

The contract is flexible in length but will cover the appropriate period for your application to study in the UK which would normally be 10-15 months. The termination date of the contract is your due start date at university, irrespective of the success of your application/s. If you request an extension, this will be at the discretion of PMC and an additional fee may be required.

Should PMC be unable to provide the Service to fulfil these Terms in full or part, any monies received by PMC will be repaid to you on a percentage basis pursuant to the amount of Service received by you under the contract and these Terms.

Individual Report

You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of your Individual Report.

Admission to University

PMC does not guarantee admission into one or all of your university choices. PMC will offer advice and guidance to you regarding those courses and institutions which are most suitable for you and will assist with the preparation of materials to enable you to present a well-researched and written application.

Financial Inducements

PMC does not receive any payments or financial inducements from any UK university or higher education institution. Advice and guidance is given on a completely impartial basis, tailored to the courses and universities which are best suited to you based on the information supplied during Registration and thereafter.

Fees

The Service is available for a single fee which must be paid in advance during Registration. The current fee is that which is charged during Registration and is subject to change prior to Registration. Once the fee has been paid and the Contract entered into, the fee cannot be increased for the duration of the Contract.

Payment

Payments are taken and processed by PayPal on the PayPal website on behalf of PMC. All credit and debit card holders are subject to validation checks and authorisation by the card issuer and PayPal. If the issuer of the payment card refuses to authorise payment, PMC will not be liable for any delay experienced in the provision of the Service. All authorisation issues should be referred to the card issuer and/or PayPal as appropriate.

Privacy

PMC respects your privacy and is committed to protecting it. PMC provides this Privacy Statement to inform you of PMC’s Privacy Policy and practices. The Website has been designed so that, in general, you can visit the Website without identifying yourself or revealing any personal information.

Personal Information

You are required to supply Personal Information such as name, address, date of birth, contact details, academic information and other optional data when you Register for the Service. You warrant that this information is true, accurate, current and complete in all respects, that you will notify PMC immediately of any changes to your Personal Information, and you agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

Personal Information is retained electronically and manually by PMC to facilitate the Services delivered to you and is subject to the English Data Protection Act 1998. Appropriate security measures have been implemented to prevent unlawful or unauthorised processing of your Personal Information and against accidental loss of, or damage to, your Personal Information.

PMC will never sell or share your Personal Information with third parties and will not transfer your Personal Information to a country outside the European Economic Area unless specific permission has been requested and granted by you.

Contact Forms

Information supplied to PMC using the Contact Forms used by this Website is retained electronically and manually by PMC to facilitate the enquiry and any follow-up communication and is subject to the English Data Protection Act 1998. Appropriate security measures have been implemented to prevent unlawful or unauthorised processing of the information and against accidental loss of, or damage to, the information supplied on the Contact Forms.

PMC will never sell or share the information supplied on the Contact Forms with third parties and will not transfer this information to a country outside the European Economic Area unless specific permission has been requested and granted by you.

Cookies

Cookies are small pieces of information which are stored by your internet browser on your computer’s hard drive. They do not in themselves recognise the individual user but will recognise the computer you are using. Most browsers will automatically accept Cookies but you can change the settings on your browser to prevent this happening should you wish.

Security

Once you have completed Registration on this Website, your payment of the fee is taken and processed by PayPal on the PayPal website on behalf of PMC. PayPal is protected by a Verisign SSL Certificate ensuring all data you send via the PayPal website, including your credit/debit card number, name and address, is encrypted and converted into code before it is securely transmitted over the internet.

Do not send credit/debit card details via the Contact Forms or standard email as these are not secure. Please use the Registration process and the PayPal website to ensure security of your credit/debit card details.

In the unlikely event of unauthorised use of your credit card or debit card, you should contact your card issuer immediately as per your contractual arrangement with them. Most banks and credit card companies will either cover the charges that result or may limit your liability to a relatively small amount.

The Website, the Service and the site content are provided "as-is" and PMC disclaims any and all representations and warranties, whether express or implied, including without limitation implied warranties of title, merchantability, fitness for a particular purpose or non-infringement. These Terms govern the relationship between PMC and you. Any changes to these Terms must be in writing and signed by both parties. In this way, any problems surrounding what PMC and you are expected to do can be avoided. You confirm that, in agreeing to accept these Terms, you have not relied on any representation save insofar as the same has expressly been made a part of these Terms and you agree that you shall have no remedy in respect of any representation. Your Statutory Rights are not affected by these Terms. Nothing in this clause shall limit or exclude PMC’s liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a part of the Terms.

Law

The Terms shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.
